在安装Windows Vista后，也许您会发现有些应用程序在Windows Vista中会出现某种问题————也是我们极力强调在安装Windows Vista前检查系统兼容性的原因——而想将系统回复到以前使用的版本，如Windows XP。Anyway，也可能出于其他原因，您想卸载Windows Vista，下面简要介绍一下Windows Vista的卸载方法。　　
Windows Vista是PC唯一操作系统时的卸载
　　对于PC中只安装Windows Vista一款操作系统的情况，卸载相对简单得多，备份重要的数据文件如Word文档、邮件等后，直接将硬盘分区格式化即可。
Windows Vista与其他操作系统共存时的卸载
　　前面我们介绍过，Windows Vista采用了Windows 2000/XP不同的Boot Loader，在安装Windows Vista后，硬盘的引导过程即由Windows Boot Manger (bootmgr)接管，因此，在双重引导/多重引导的系统中直接删除Windows Vista将会导致系统启动时因Boot loader丢失而失败。
　　下面以系统中同时安装Windows Vista与Windows XP，以双重启动方式分别引导进入各自系统的情况为例介绍Windows Vista的卸载方法。
Windows XP与Windows Vista安装在不同分区中的简单方法
　　以管理员帐户登录Windows XP，右键单击桌面上“我的电脑”图标，选择“管理”，在弹出的“计算机管理”窗口中选择“存储” => “磁盘管理”；
　　选中Windows Vista的安装分区，在右键菜单中选择“格式化”——当然，如果该分区中保存着重要的数据，请事先备份；
　　在运行对话框中输入“msconfig”，启动系统配置实用程序，然后选择 “BOOT.INI”选项卡，点击其中的“检查所有的启动路径”；
　　检查完成后点击“确定”、“应用”，这时系统会询问是否重启，应选择“退出而不重新启动” 接下来，在系统盘如C：根目录中查找如下文件，并删除之。——首先应设置文件夹的查看选项，设置能够看到系统文件与隐含文件。 Boot (目录)] Boot.BAK BOOTSECT.BAK 如果因权限不够而无法删除，请首先让管理员取得该文件或目录的所有权并设置删除权限。
　　然后重启计算机即可。
　　这种方式的操作相对简单，缺点则在于其并未真正完全清除系统中存在的Windows Vista安装，不过，在大多数情况下能够保证Windows XP的正常启动与运行。
复杂情况如Windows Vista与XP安装在同一分区或多重启动时的卸载
　　对于复杂的安装场景如多重启动或希望完全清除Windows Vista的安装，则需要使用Windows XP的故障恢复控制台。
　　进入BIOS设置PC从光驱启动，将Windows XP安装光盘插入光驱，启动系统；
　　在出现安装选项的启动画面时，选择“R”进入故障恢复控制台；(说明：如果您的系统需要附加的SATA/RAID驱动，则应在出现此界面前按“F6”首先加载相应的驱动。)
　　选择要登录到的Windows XP系统，系统会给出相应的操作系统列表，输入正确的序号；输入管理员密码，以进行修复；
　　运行“fixboot”命令，重写系统硬盘的引导信息；输入“exit”退出故障恢复控制台并重启，此时，Windows Vista的Boot Loader已从系统中清除了。
　　启动进入Windows XP，如果您的Windows Vista安装在单独分区中，可按上面介绍的方法使用磁盘管理器直接将该分区格式化；
　　而对于更复杂的情况，如Windows Vista与其他系统共用分区，则可直接将Windows Vista的目录或文件删除，如“Windows”、“Users”等目录；
　　同样地，按上面介绍的办法，删除系统硬盘根目录下的“Boot”目录和“Boot.BAK”、“BOOTSECT.BAK”文件以及“bootmgr”文件，至于回收站，可根据情况判断是否删除；
　　右键单击“我的电脑”，依次选择“属性” => “高级”=>“启动与故障恢复” =>“设置”，检查Windows XP是否为默认操作系统，如否，将其设为默认；
　　点击该页中的“编辑”按钮，这将使用记事本打开“boot.ini”文件，找到其中与Windows Vista相关的设置并逐一删除；
　　为安全起见，完成上列步骤后可使用“msconfig”检查启动项是否设置无误，按上面介绍的方法，在系统配置实用工具“BOOT.INI”页中点击“检查所有的启动路径”，出现“看起来所有BOOT.INI中的Microsoft操作系统行都正确”——相当别扭的一句话，估计按小学语文老师的标准，微软中国公司的部分人需要重修——即大功告成。

DOS下破除Windows XP登陆密码

用DOS启动，在命令行里把system32\config的SAM换一个就可以了，输入： del c:\windows\system32\config\samcopy c:\windwos\repair\sam (有个空格）c:\windows\system32\config然后重启进入Windows，有个提示不要管他，点击确定，这样就能进入系统了。如果是Windows2000就用： del c:\windows\system32\config\sam就可以了。如果是用Administrator用户这样就可以了，但要是用其他用户就要启动时按住“F8”选“带命令行安全模式”，然后用这个： net user 你以前创的用户名新密码例如:用户名是hades，我想把密码改成123456，那么就是： net uset hades 123456如果不清楚有哪些用户名可以用“net user”来查看。

从昨天晚上开始，不少人向我反应Google的博客服务BlogSpot再次无法访问。

　　我自己验证了一下，我的确也无法访问，根据我的检测，无法访问的原因是72.14.219.191的IP无法访问，具体原因不能确认，可能是BlogSpot更改IP地址，也可能是这个IP本身就被GFWed了。

　　从BlogSpot解封到现在再次无法访问，大概有2个半月时间，看来最终还是要被封，这里我想到了一件事情，就是最近炒的沸沸扬扬的博客实名制，很多人质疑博客实名制的主要原因是，实名制会将Blogger赶到国外，不过现在BlogSpot再次无法访问提醒我们，Blogger被赶到国外实在是杞人忧天，要想使用国外的博客服务，也是需要有关部门同意才可以。

　　目前的博客实名制据说和以前的网站备案类似，实际上，独立域名的Blogger大多都已经实名备案了，也就不存在实名不实名的问题，出了问题肯定找的到人，目前的问题主要是针对博客托管服务（BSP）的用户，备案的时候会要求输入手机号码，这个手机号码的目的就是为了能快速找到你的个人，目前有关部门就经常打我手机要我去删除网站上的某某信息。这种实名制实际上是对个人的一种威慑，但是将个人实名公布到网站上估计不太可能，我估计博客实名制实际上应该叫博客备案才更准确。

　　最后，对于BlogSpot的博客，我发现通过修改hosts 文件还是可以间接访问的，具体方法是：编辑WINDOWS\system32\drivers\etc\hosts 文件，然后加入72.14.219.190 xxx.blogspot.com ，其中xxx是你的用户名，即可访问到你自己的BlogSpot了。

　　更新：26日晚上，72.14.219.191这个IP又可以访问了，我查看了几个BlogSpot地址，全都可以访问了，但是到了27日，这些地址又无法访问了。

今天，有多位读者向我反馈，Google Blogger似乎无法访问了，我立刻对此进行了测试，得出的结论是BlogSpot的IP地址72.14.207.190目前无法访问。

　　测试的截图如下所示：

　　最后一个IP为202.97.35.49，经过查询为“全国（电信骨干路由器）电信”，因此可以判断BlogSpot无法访问不是因为Google服务器坏了。

　　要想继续访问，可以采用上次我介绍的方法：编辑WINDOWS\system32\drivers\etc\hosts 文件，然后加入72.14.219.190 xxx.blogspot.com ，其中xxx是你的用户名，即可访问到你自己的BlogSpot了。

　　令一个奇怪的现象是，我前几天曾经发现我的MSN SPACES空间无法访问，而今天却又可以访问了，反而倒是Google又不能访问。

　　Google的公关同志们，考验你们的时刻到来了，现在该是行动的时候了。恢复BlogSpot的重任就寄托在你们身上了。

　　更新：3月28日，Google Blogger又可以访问了，不过3月29日再次无法访问，另外pkblogs这个绕到访问的方法也无效了。

　　更新：4月1日，Blogspot又可以访问了，这么反反复复，可怜这些用户啊。

　　更新：4月5日，Blogspot又无法访问啦。终于明白了一个道理：神仙在玩儿我们呢。

　　更新：4月15日，Blogspot可以正常访问。

　　更新：5月11日，再次被封。5月14日解封。莫非有人在耍猴？

　　更新：5月28日，再次被封。

　　大家请猜一下，下一次Blogspot不能访问会是什么时候？

Yoko Kumada（熊田曜子 Kumada Yoko、May 13, 1982 - ） is a Japanese gravure idol and singer. She is originally from Gifu city, Gifu Prefecture, Japan. Her height is 164cm. Three sizes are B92 W56 H84. Yoko originally applied to be a contestant of Miss Magazine in her third year of high school but had to drop out due to her mother’s strong disapproval. Yoko went on to nursing school after her graduation, but also entered a talent agency’s audition in order to pursue her dream of being part of the entertainment world. She was only able to do this because her mother was travelling abroad at the time and her flight home was delayed due to bad weather. Lee Hyori is a member of the Korean pop group Fin. K.L. but also went solo in 2003, Fin. K.L. stands for “Fine Killing Liberty”, which loosely translates into the “fin” (i.e the end) of “liberty killing,” which means that the girls will stand up against and put an end to anything that will “kill (our) liberty.” The name was chosen for the band by DSP Entertainment even before the members were chosen. Lee Hyori, who would become the group leader due to Lee Hyori being the oldest, was discovered while taking sticker pictures with her friends and was actually the last to join the group, just before their launch in January 1998. Fin. K.L. debuted officially on May 22, 1998 with their first single “Blue Rain.” It was received quite well, but it was not until their second release from their first album: To My Boyfriend, that Fin. K.L. truly proved their popularity and “To My Boyfriend” became the first of their numerous number 1 hits. Following their fourth album Forever, Hyori launched her solo career: first as an MC, of “Time Machine” and “Happy Together” and then with the release of her first album, Stylish E.

Lee Hyori swept the Daesangs, the most prestigious of Korean music awards, of 2003, winning more than 7 ‘artist of the year’ awards. Her first solo album, Stylish E, sold more than 170,000 copies in Korea alone. She also appeared as the lead female actress in the SBS drama Three Leaf Clover co-starring opposite Ryu Jin, Kim Jung Hwa, Kim Kang Woo & Lee Hoon. Hyori’s popularity, in her various activities, eventually came to be dubbed as “Hyori Syndrome” in South Korea, and the Korean Media nicknamed 2003 “The Year of Hyori” as she was rarely out of the news all year.

While the debut solo album of her teammate Oak Joo-hyun has been so well received, it is high time Lee Hyo-lee, who is the leader of the Korean female quartet Fin.K.L. (Fine Killing Liberty), bombarded the Korean music industry with her premier work “Lee Hyo Lee Vol.1″!

August in 2003 seems to a year full of new surprises for Hyo-lee (a.k.a Chori). It is the month not only for her solo album to be released but also for her debut movie “Sam Soo Sang’s Love Story” to begin shooting in which she plays YooNi, an innocent and beautiful art student. As the first project to be presented between her two debuts, this very first album abounds in musical genres of different sorts including hip-hop, funky, dance, ballad, trendy R & B, trance and many more. Together with her own contribution, Hyo-lee this time is joined by Ahn Jung-hoon, the former Position member, as the producer, Cho Kyu-man, Kim Do-hyun, Yun Il-sang, Lee Hyun-do and a lot more top elite in the local industry.
This lady representing the color of red in Fin.K.L. is not going to spare her red hot heat in the summer of 2003 and all that begins with her title track “10 Minutes”, a mid-tempo hip-hop tune with overwhelming background music and groovy rhythm that keeps your body moving along.

　　(1)万宁公司单方面通知兴隆啤酒厂中止履行合同合法。因为，《合同法》规定，双务合同成立后，应当先履行债务的当事人，有确切证据证明对方不能履行债务或者有不能履行债务的可能时，在对方没有履行或者没有提供担保之前，有权中止履行合同义务。兴隆啤酒厂突发火灾，设备、原料大部分被烧毁，严重影响了履行债务的能力。因此，万宁公司可以行使不安抗辩权，中止履行。

　　(2)振明公司拒绝万宁公司要求其为兴隆啤酒厂承担保证责任的要求符合法律规定。依据《担保法》的规定，一般保证的保证人在主合同纠纷未经审判或者仲裁，并就债务人财产依法强制执行仍不能履行债务前，对债权人可以拒绝承担保证责任。所以，万宁公司应先找兴隆啤酒厂要求其承担法律责任。

　　2、南方工业公司与国华机械厂签订合同，约定由国华机械厂为南方工业公司生产10符合一定标准的机床；并约定南方工业公司预付货款3万元，机床安装使用后，如无质量问题，再支付其余货款；同时双方签订仲裁协议，约定合同履行过程中如发生纠纷，则向某仲裁委员会申请仲裁。

　　南方工业公司将机床安装投入生产后，加工的产品废品率大大超过合同规定标准。经检查，产生废品的原因是机床的一个重要参数不合格，国华机械厂多次派人对机床进行修理，仍不能达到合格标准。为此给南方工业公司造成5万元的经济损失。

　　（1）万方农贸公司有权解除合同，合同法规定，因不可抗力致使不能实现合同目的的，当事人可以解除合同，禽流感属于不能预见、不能避免并不能克服的客观情况，即不可抗力。因此，万方农贸公司依法有权解除合同。

　　（2）绿岛家禽养殖场可以免除不能履行合同的违约责任。根据合同法的规定，因不可抗力不能履行合同的，根据不可抗力的影响，部分或者全部免责。

　　（3）绿岛家禽养殖场应返还万方农贸公司预付款，合同法规定，合同解除后，尚未履行的，终止履行；已经履行的，根据履行情况和合同性质，当事人可以要求恢复原状、采取其他补救措施，并有权要求赔偿损失。绿岛家禽养殖场依法可以免除解除合同的违约责任，而且该款不属于定金，因此，绿岛家禽养殖场应返还万方农贸公司预付款。

　　（4）绿岛家禽养殖场不服仲裁机构裁决而向法院起诉，法院不应受理。仲裁实行一裁终局制度。裁决作出后，当事人就同一纠纷再申请仲裁或者向人民法院起诉的，仲裁机构或者人民法院不予受理。

　　（5）万方农贸公司不经仲裁而直接向法院起诉，不符合法律规定。当事人达成仲裁协议，一方向人民法院起诉未声明有仲裁协议，人民法院受理后，另一方在首次开庭前提交仲裁协议的，人民法院应当驳回起诉。仲裁或诉讼只能选其一，有仲裁协议，只能仲裁。

如何区别违约金、定金、订金、诚意金、佣金

　　违约金
　　违约金是由当事人约定的或者由法律直接规定的，在违约方不履行合同时，偿付给守约方的一定数额的货币。根据相关的法律法规来看，违约金可分为法定违约金与约定违约金。法定违约金是指在一些法规中，明文规定的违约金比例或幅度范围；约定违约金是指合同双方当事人在签订合同时自愿约定的违约金比例或数额。而法学理论界又从违约金的法律后果将违约金分为补偿性违约金和惩罚性违约金二种。支持补偿性违约金的学派认为违约金主要是为了弥补守约方受到的损失。持惩罚性观点的学者认为，违约金主要是为了确保合同的履行，而事先约定的对违约方进行的一种惩罚。
　　但从我国的司法实践来看，二者兼而有之，但主要是一种补偿性的赔偿。如合同法第一百一十四条规定，“当事人可以约定一方违约时应当根据违约情况向对方支付一定数额的违约金，也可以约定因违约产生的损失赔偿额的计算方法。约定的违约金低于造成的损失的，当事人可以请求人民法院或者仲裁机构予以增加；约定的违约金过分高于造成的损失的，当事人可以请求人民法院或者仲裁机构予以适当减少。当事人就迟延履行约定违约金的，违约方支付违约金后，还应当履行债务。”
　　因此我们在签定合同时要对违约金作出明确的约定。尤其是在现在房产市场活跃、涨幅较大时期，购房者最好把违约金约定高一点。这样不仅对上家是一个约束，同时也使自己权益遭受侵害后能得到最大限度的赔偿。

　　定金
　　定金指合同当事人为保证合同履行，由一方当事人预先向对方交纳一定数额的钱款。合同法第一百一十五条规定“当事人可以依照〈中华人民共和国担保法〉约定一方向对方给付定金作为债权的担保。债务人履行债务后，定金应当抵作价款或者收回。给付定金的一方不履行约定的债务的，无权要求返还定金；收受定金的一方不履行约定的债务的，应当双倍返还定金。”这就是我们通常说的定金罚则。第一百一十六条规定“当事人既约定违约金，又约定定金的，一方违约时，对方可以选择适用违约金或者定金条款。”。《中华人民共和国担保法》第九十条规定，“定金应当以书面形式约定。当事人在定金合同中应当约定交付定金的期限。定金合同从实际交付定金之日起生效。”；第九十一条规定，“定金的数额由当事人约定，但不得超过主合同标的额的百分之二十”。《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》第四条规定“
　　出卖人通过认购、订购、预订等方式向买受人收受定金作为订立商品房买卖合同担保的，如果因当事人一方原因未能订立商品房买卖合同，应当按照法律关于定金的规定处理；因不可归责于当事人双方的事由，导致商品房买卖合同未能订立的，出卖人应当将定金返还买受人。“
　　因此从法律角度看，定金有双重性质。第一，它可作为合同的担保，以保证合同履行。第二，可以起到合同成立的证明作用。定金作为一把双刃剑，还具有惩罚性。即给付定金的一方不履行合同的，无权要求返还定金；接受定金的一方不履行合同的，要双倍返还定金。定金作为法定的形式，法律有其具体的要求：
　　1、形式要件，必须签定书面的形式；
　　2、数额的限定，定金的总额不得超过合同标的的20%；
　　此外在选择赔偿时只能在定金和违约金中选其一。

　　订金
　　订金与定金仅一字之差，在法律性质上却有天壤之别。订金不是一个规范的概念，在法律上仅作为一种预付款的性质。是预付款的一部分，是当事人的一种支付手段，不具有担保性质。合同履行的只作为抵充房款，不履行也只能如数返还。《最高人民法院关于适用〈中华人民共和国担保法〉若干问题的解释》第一百一十八条规定“当事人交付留置金、担保金、保证金、订约金、押金或者订金等，但没有约定定金性质的，当事人主张定金权利的，人民法院不予支持”。由此可见，当事人在合同中写明“订金”而没有约定定金性质的，则不能适用定金罚则。因此，购房者签字时一定要认真仔细不要写错，否则到时后悔不迭。

　　诚意金
　　诚意金，即意向金，是十几年前从港台地区传过来的叫法。这在中介与买房和卖房双方签定的合同中多有体现，其实法律上并没有诚意金之说，中介与买卖双方之所以签定什么诚意金条款，主要是由于我们交易市场的诚实信用体系还不健全，交易主体为了各自的利益往往会违背诚实信用的原则，从而损害一方的利益。中介公司有时为了自己的利益，不管交易成功与否，便以买方或卖方没有诚意或违约为名没收诚意金，其实这种做法有背于法律。
　　中介公司在房屋买卖中一般充当居间介绍或作为买或卖一方的代理人。作为前者中介是独立于买卖双方之外的第三者，根据合同法第四百二十六条规定，“居间人促成合同成立的，委托人应当按照约定支付报酬。对居间人的报酬没有约定或者约定不明确，依照本法第六十一条的规定仍不能确定的，根据居间人的劳务合理确定。因居间人提供订立合同的媒介服务而促成合同成立的，由该合同的当事人平均负担居间人的报酬。居间人促成合同成立的，居间活动的费用，由居间人负担。”。第四百二十七条规定“居间人未促成合同成立的，不得要求支付报酬，但可以要求委托人支付从事居间活动支出的必要费用。”由此可以看出，此时中介只有在促成房屋买卖双方合同成立的情况才可以要求买卖双方或一方（有特殊约定的情况）给予报酬。作为后者，中介是买卖双方中一方的代理人，根据《中华人民共和国民法通则》第六十四条第二款规定，“委托代理人按照被代理人的委托行使代理权，……”。第六十六条第二款规定， “代理人不履行职责而给被代理人造成损害的，应当承担民事责任。”。合同法第四百零五条规定“受托人完成委托事务的，委托人应当向其支付报酬。因不可归责于受托人的事由，委托合同解除或者委托事务不能完成的，委托人应当向受托人支付相应的报酬。当事人另有约定的，按照其约定。”。第四百零六条规定“有偿的委托合同，因受托人的过错给委托人造成损失的，委托人可以要求赔偿损失。无偿的委托合同，因受托人的故意或者重大过失给委托人造成损失的，委托人可以要求赔偿损失。受托人超越权限给委托人造成损失的，应当赔偿损失。”从民法通则和合同法的规定可以看出，在这一法律关系中，中介作为一方的代理人要按照委托合同的约定从事代理活动，并取得报酬。
　　因此无论是作为居间介绍还是作为买卖双方中的一方代理人，都不存在什么诚意金问题。购房者一定要看清合同具体条款再签字，尤其是诚意金的处理方式。

　　佣金
　　佣金是指经纪人（房产中介）在为委托人（买房人或卖房人）提供订约机会或充当订约介绍人，完成委托人的中介服务后，由委托人支付的劳动报酬。因此佣金是房屋买卖活动中中介的劳务所得，经纪人完成经纪活动后，有权按照合同约定收取佣金。收取佣金的标准，以双方约定或参照商业惯例为准，不得违反国家法律、法规和政策。目前上海的房产中介收费一般是按照交易额收取（上家0.5-1%，下家 1%）。

合同的解除和撤销区别何在？

　　合同的解除和撤销虽然都是合同消灭的制度，但两者并不相同。合同解除，是指在合同有效成立后，当解除合同的条件具备时，因当事人一方或双方意思表示，使合同自始或仅向将来消灭的行为。双方当事人以协议方式解除合同或者一方行使约定解除权而解除合同称为合意解除。合同解除的条件由法律直接加以规定的称为法定解除。在法定解除中，有的以适用于所有合同的条件为解除条件，有的则仅以适用于特定合同的条件为解除条件。前者为一般法定解除，后者为特别法定解除。《中华人民共和国合同法》（以下简称合同法）第九十四条规定了一般法定解除条件：“（一）因不可抗淡力致使不能实现合同目的；（二）在履行期限届满之前，当事人一方明确表示或者以自己的行为表明不履行主要债务；（三）当事人一方迟延履行主要债务，经催告后在合理期限内仍未履行；（四）当事人一方迟延履行债务或者有其他违约行为致使不能实现合同目的；（五）法律规定的其他情形”。合同法第二百一十九条规定了仅仅适用于特别合同（租赁合同）的解除条件：“承租人未按照约定的方法或者租赁物的性质使用租赁物，致使租赁物受到损失的，出租人可以解除合同并要求赔偿损失”。可撤销合同，是指当事人在订立合同时，因意思表示不真实，法律允许撤销权人通过行使撤销权而使已经生效的合同归于无效。合同法第五十四条规定：“下列合同，当事人一方有权请求人民法院或者仲裁机构变更或者撤销：（一）因重大误解订立的；（二）在订立合同时显失公平的。一方以欺诈．胁迫的手段或者乘人之危，使对方在违背真实意思的情况下订立的合同, 受损害方有权请求人民法院或者仲裁机构变更或者撤销”。

　　合同的解除和撤销主要区别在于：其一，从适用范围来看，撤销的适用范围比较广泛，不仅适用于欠缺有效要件的合同领域，而且适用于有瑕疵的意思表示及民事行为场合；而解除仅仅适用于有效成立的合同提前消灭的情况。其二，从发生原因来看，撤销的原因由法律直接规定；而解除的原因既有法律规定的，也有当事人约定的。其三，从发生的效力看，撤销都有溯及力，被撤销的民事行为从开始起无效；而解除则往往无溯及力，只有在当事人有特别约定或者法律有特别规定及违约解除非继续合同时，才有溯及力。

什么是要约？什么是承诺?

　　当事人订立合同，采用要约、承诺方式。要约人提出订立合同的条件，受要约人完全接受，表明双方的意思表示一致，合同的订立过程结束。
　　(1)什么是要约?　
　　要约是一方当事人向另一方当事人提出订立合同的条件。希望对方能完全接受此条件的意思表示。发出要约的一方称为要约人，受领要约的一方称为受要约人。　
　　①要约的条件：a.要约的内容必须具体明确。所谓“具体”是指要约的内容必须具有足以使合同成立的主要条款。如果没有包含合同的主要条款，受要约人难以做出承诺，即使做出了承诺，也会因为双方的这种合意不具备合同的的主要条款而使合同不能成立。所谓“确定”，是指要约的内容必须明确，而不能含糊不清，否则无法承诺。b.要约必须具有订立合同的意图，表明一经受要约人承诺，要约人即受该意思表示的拘束。　
　　②要约的效力。《合同法》第16条规定：“要约到达受要约人时生效。”自要约实际送达给特定的受要约人时，要约即发生法律效力，要约人不得在事先未声明的情况下撤回或变更要约，否则构成违反前合同义务，要承担缔约过失的损害赔偿责任。需明确一点，到达是指要约的意思表示额观上传递到受要约人处即可，而不管受要约人主观上是否实际了解到要约的具体内容。例如，要约以电传方式传递，受要约人收到后因临时有事未来得及看其内容，要约也生效。　
　　③要约的失效。要约发出后，有下列情形之一的，要约失效，要约人不再受原要约的拘束：a.要约的撤回。撤回要约的通知应当在要约到达受要约人之前或者与要约同时到达受要约人。b.拒绝要约的通知到达要约人。受要约人以口头或书面的方式明确能知要约人不接受该要约。c.受要约人对要约的内容进行实质性变更。有关合同标的、数量、质量、价款或报酬、履行期限、履行地点和方式、违约责任和解决争议方法等的变更，是对要约内容的实质性变更。d.要约中规定有承诺期限的，承诺期限届满，受要约人未作出承诺。对口头要约，在极短的时间内不立即作出接受的意思表示，则表明要约的失效。e.要约的撤销。要约可以撤销，撤销要约的通知应当在受要约人发出承诺通知之前到达受要约人。但是，有下列情形之一的，要约不得撤销：A.要约人确定了承诺期限或者以其他形式明示要约不可撤销；B.受要约人有理由认为要约是不可撤销的，并已经为履行合同作了准备工作。　
　　④要约撤回与要约撤销的区别。二者的区别仅在于时间的不同，要约的撤回是在要约生效之前为之，即撤回要约的通知应当在要约到达受约人之前或者与要约同时到达受要约人；而要约的撤销是在要约生效之后承诺作邮之前而为之，即撤销要约的通知应当在受要约人发出承诺通知之前到达受要约人。　
　　⑤要约与要约邀请的区别。a.要约邀请是指一方邀请对方向自己发出要约，而要约是一方向他方发出订立合同的意思表示；b.要约缴不是一种意思表示，而是一种事实行为。要约是希望他人和自己订立合同的意思表示，是法律行为；c.要约邀请只是引诱他人向自己发出要约，在发出邀请要约邀请人撤回其中邀请，只要未给善意相对人造成信赖利益的损失，邀请人并不承担法律责任，以下四个法律文件为要约请：寄送的价目表、拍卖公告、招标公告、招股说明书。

　　(2)什么是承诺?　
　　承诺是指受要约人同意要约的意思表示。承诺应当以通知的方式作出，但根据交易习惯或者要约表明可以通过行为作出承诺的除外。　
　　①承诺的条件：a.承诺的主体只能是受要约人。这意味着，非受要约人作出的承诺的意民表示并非承诺，而是向要约人发出的要约。b.承诺的内容是同意要约，它强调承诺的内容与要约的内容应当一致。承诺实质性变更要约的，为新要约。我国合同法对承诺与要约内容的一致性原则作了灵活处理，允许承诺作出大量实质性变更。c.承诺应当在要约确定的期限内到达要约人。要约没有确定承诺期限，承诺应当按照下列规定到达：要约以对话方式作出的，应当及时作出承诺，但当事人另有约定的除外；要约以对话方式作出的，承诺应当在合理期限内到达。　
　　②承诺迟到的效力。a.因承诺自身原因迟到的，原则上承诺无效，为新要约。《合同法》第28条规定：“受要约人超过承诺期限发出承诺，除要约人及地通知受要约人该承诺有效的以外，为新要约。”b.因非由于承诺人自身原因迟到的，原则上承诺有效。《合同法》29条规定：“受要约人在承诺期限内发出承诺，按照通常情形能够及时到达要约人，但因其他原因承诺到达要约人时超过承诺期限的，除要约人及时通知受要约人因承诺超过期限不接受该承诺的以外，该承诺有铲。”　
　　③承诺的效力。承诺通知到达要约人时生效。承诺不需要通知的，根据将近易习惯或者要约的要求作出承诺的行为时生效。承诺的生效亦采取到达主义，与要约相同。承诺生效时合同成立，承诺生效的地点为合同成立的地点。　
　　④承诺的失效。有下列情形之一的，受要约人接受要约所做的答复不发生法律效力：a.承诺撤回。承诺人可以发出承诺后又撤回承诺，但撤回承诺的通知应当在承诺通知到达要约人之前或者与承诺通知同时到达要约人。b.承诺逾期，要约方没有认可其为承诺。

Use a secure password. It should be at least 6 characters long and contain both letters and numbers. In addition, you should change your password periodically.
Choose admins carefully. Avoid choosing people that think differently than you, and avoid any members that have left and returned or previously broken rules.
Never give out your password. If you are asked for it, the person is probably trying to break into your board. Take caution when replying to what looks like official emails. We will only ask you to confirm your board password if you have previously requested your board to be deleted. If you have not requested your board to previously be deleted, then do not reply.
Never give out a link to your Admin CP. In some instances, the URL can grant access to an attacker.

Don't use Hotmail

Invision Power Board is an Internet forum software produced by Invision Power Services, Inc. Written in PHP and primarily using MySQL (other database engines are available), it is comparable to other forum software.

Version 1.3 was the last free of charge version, and IPS still permits it to be used, but does not offer a download or support. This is the only version of IPB free IPB hosting companies can use (the ipb2.x+ license does not allow hosting multiple boards by using the same license).

Regardless of the lack of help, many users still use the older version, even though it has known security holes. Up until 2005, IPS offered security fixes, but with the advent of version 2.1, these have ceased. 3）反向链接（质量和数量）
反向链接就是导入链接，其质量和数量代表了这个页面的质量，有好的高质量的网站来的链接会给页面的排名好的影响。

4）反向链接的链接文字
这个文字会影响用这个关键词搜索时网页的排名。用关键词或者相关关键词来做链接文字是比较好的。

5）域名的年龄
域名的年龄同可信度有关，这并不是说刚注册的域名可信度有问题，而是可信度的建立需要时间，就像在人们实际交往的社会中一样，信誉不是一天就可以建立的。

用新版Google Analytics来看本站最近两个月的情况

新版的Google Analytics已经出来几天了，很多网站都对此有所介绍，我就不狗尾续貂了。还是像以前一样，来看看本站的表现吧。

统计分析的时间段是从三月一日到五月十五日。
访问者统计，从三月初的100出头一点，到最近的三百多，增长还是明显的，趋势还是稳定的。

Baidu还是一路领先，占有36.15%。
Google紧随其其后，有20.92%。
当然这也是因为SEO网站优化推广是简体中文的，而且访问者绝大多数来自于中国大陆。

从这样的报告中，可以看出多少内涵，就要看个人的修为了。

Bloggerwave又一家类似ReviewMe的广告公司

今天想介绍一下这家同ReviewMe同类型的话题广告公司，Bloggerwave。

五月中旬，我已经申请了Bloggerwave的帐号，并且在五月二十三日已经写了一篇介绍的文章，他们的效率不错，很快，就通过了。并且在昨天，也就是六月二日就支付了。

注册过程比较简单：
1) 申请帐号；
2) 添加最多五个Blog，并且需要审核；
3) 接着就可以选取你所感兴趣的话题，或者评估题目来做；
4) 写完之后就是提交，并等待审核；
5) 通过后就会在月底支付。

目前看来它还是有些令人不是很满意的地方，也是不能吸引很多Blogger来参加的一个主要原因。
话题太少，我看到的只有三个。
价格太低，最高只有$10，也就可以买四杯starbucks咖啡的。

不管怎样，在话题广告的领域引入更多的竞争总是好事，这样Blogger们可以有更多的机会来获得收入，即使是那样少的金额，可是买杯咖啡喝总是好的。

顺便说一下，是通过Paypal来支付的，应该是国际paypal，看看支付细节。
